What is the Register of Deeds?


The Register of Deeds is an electable position. The duties of this position can vary slightly from municipality to municipality and state to state. South Carolina register of deeds falls under the common law system. Lexington County possesses land records dating back to 1839.

The scope of the register of deeds (sometimes called the recorder of deeds) is to document deeds, mortgages, mortgage satisfactions, powers of attorney, mechanic liens, tax liens, plats, universal commercial code filings, and other real property transactions. Then the documents are made for public access.

The importance of this position is to ensure accurate records of real property and make the information available to the public. This information is critical to the public and information should be as accurate as possible. Many aspects of society rely heavily on the information provided by the register of deeds. Examples are but not limited to contractors, Tax assessors, Real estate agents, sub contractors, real estate attorneys, probate courts, civil courts, land developers, and building inspectors.  It is also a valuable service in preserving historic record of real property.

The register of deeds is a crucial part of our govt. and why the people are chosen to elect this person opposed to being appointed.
